DLSA, UTRC Conduct Joint Review of Jail Conditions, Legal Aid Mechanisms in Kupwara

Kupwara: In a comprehensive exercise aimed at strengthening access to justice and improving custodial conditions, the District Legal Services Authority (DLSA) Kupwara and the Undertrial Review Committee (UTRC) on Wednesday carried out a quarterly inspection of District Jail and Sub Jail Kupwara, in line with guidelines laid down by the Supreme Court of India.

The inspection was led by the Principal District and Sessions Judge Kupwara, who also serves as Chairman DLSA Kupwara. On arrival at the District Jail, the Chairman was received by the Superintendent Jail. The visit was conducted in the presence of Deputy Commissioner Kupwara Shrikant Balasaheb Suse, Secretary DLSA (Civil Judge Senior Division) Javid Ahmad Parray, Additional Superintendent of Police Kupwara Shahzad Kabeer Mattoo, SP Jail Syed Ghazanfar, Chief Prosecution Officer Mohsin Khan, Chief Legal Aid Defence Counsel Advocate Muzamil Bhat, along with Legal Aid Defence Counsels (LADCs), Para Legal Volunteers (PLVs), and other concerned officials.

During the inspection, the Chairman held detailed interactions with inmates to assess their grievances and evaluate their access to legal representation. The status of undertrial prisoners was reviewed, with emphasis on expeditious disposal of cases in light of the Supreme Court’s ruling in Hussainara Khatoon vs. State of Bihar (1979), which recognizes the right to a speedy trial as a fundamental right under Article 21 of the Constitution.

The Committee also undertook case-wise scrutiny of detenues to identify those eligible for release under prevailing legal provisions and the guidelines laid down in In Re: Inhuman Conditions in 1382 Prisons (2016), which mandate periodic review of undertrials through UTRCs to address overcrowding and prolonged detention.

Inspection of facilities included a review of food quality, kitchen hygiene, medical care, sanitation, drinking water, and accommodation arrangements, in line with the principles enunciated in Sunil Batra vs. Delhi Administration (1978) concerning humane conditions of detention and protection of prisoners’ rights.

Special focus was placed on the functioning of the Prison Legal Aid Clinic established under the NALSA (Legal Services to Prisoners) Scheme, 2023. The Chairman examined records and interacted with LADCs and PLVs engaged under the Legal Aid Defense Counsel System (LADCS), a flagship initiative aimed at strengthening criminal legal aid delivery.

Officials highlighted the importance of spreading awareness among inmates regarding welfare measures, including the NALSA Victim Compensation Scheme, and directed that regular legal awareness camps be conducted within the jail premises. Multiple applications seeking free legal aid were received during the visit, while inmates expressed satisfaction with the assistance being provided.

The role of Legal Aid Defence Counsels was widely appreciated, with Chief LADC Kupwara Advocate Muzamil Bhat being specifically commended for his proactive contribution to effective legal representation and implementation of the Modified LADC Scheme, 2022, particularly for economically weaker and marginalized inmates.

The Deputy Commissioner Kupwara also contributed to inmate welfare by donating sports kits to jail authorities, while additional sports kits were distributed by the District Youth Services and Sports Kupwara to promote physical activity, recreation, and overall well-being of detenues.

The Chairman issued directions for prompt redressal of grievances and emphasized enhanced coordination between jail authorities and DLSA. The inspection concluded with a reaffirmation of the commitment to uphold the mandate of free and competent legal aid under Section 12 of the Legal Services Authorities Act, 1987, ensuring equitable access to justice for all inmates.
