AIP Seeks Release of Engineer Rasheed, Welcomes Ex CJI Chandrachud’s Remarks on Right to Bail – Alfaaz – The Words

Srinagar: The Awami Itihaad Party has welcomed remarks by former Chief Justice of India D Y Chandrachud asserting that bail is a right and prolonged incarceration without trial violates fundamental rights.

The party referred to Justice Chandrachud’s recent observation that activists Umar Khalid and Sharjeel Imam, accused in the Delhi riots case and jailed for nearly five years, should have been granted bail.

In a statement, AIP chief spokesperson Inam Un Nabi said the remarks offered hope to many Kashmiris lodged in prisons for years under the Unlawful Activities Prevention Act, with trials progressing at a slow pace.

He said the former chief justice’s comments should prompt the judiciary and other institutions to act and ensure the release of political detainees from Jammu and Kashmir who continue to face extended detention without conclusion of trial.

The AIP reiterated its demand for the release of Engineer Abdul Rashid Sheikh, popularly known as Engineer Rasheed, a two time legislator and currently an elected Member of Parliament, who has spent nearly seven years in Tihar Jail.

The party said there was no legal or moral justification for his continued incarceration. It maintained that Engineer Rasheed was targeted for his political views and for raising issues related to the rights of people in Jammu and Kashmir.

The statement said prolonged detention undermines constitutional guarantees and democratic values. It urged the judiciary to uphold the principle that bail is the norm and jail an exception, particularly in cases involving long pre trial custody.

The AIP said Justice Chandrachud’s remarks reinforce the argument that even a few years of incarceration without conviction amounts to a violation of personal liberty and due process.
