SRINAGAR: The Jammu and Kashmir Legislative Assembly has passed the Jammu and Kashmir Private Universities Act, 2026, a landmark legislation aimed at opening the higher education sector to private participation while instituting a comprehensive regulatory framework to ensure quality, accountability, and student protection.

The Act seeks to address the growing demand for higher education in the Union Territory by enabling the establishment of private universities to supplement limited government capacity. At the same time, it lays down detailed safeguards to prevent commercialization and ensure adherence to academic standards.

The legislation provides a structured mechanism for setting up private universities through sponsoring bodies such as registered societies, trusts, or non-profit companies. Applicants must meet stringent eligibility conditions, including financial stability, a proven track record in education, and possession of adequate land and infrastructure.

An Expert Committee will evaluate proposals, including financial viability, academic plans, and regional relevance, before the government grants approval. The final establishment requires notification and inclusion in the official schedule of the Act.

The universities will function as unitary institutions, with powers to establish campuses and research centres within the Union Territory, but without affiliating external colleges.

A key feature of the Act is the establishment of the Jammu and Kashmir Private Universities Regulatory Authority, tasked with overseeing compliance, conducting inspections, addressing grievances, and maintaining academic standards.

The authority will also monitor enrolment trends to ensure private institutions complement rather than displace government colleges, and guide the spatial and academic distribution of new universities.

The Act mandates strict compliance with national regulatory bodies such as the University Grants Commission and other professional councils. Universities are required to obtain accreditation within five years and maintain internal quality assurance mechanisms.

Detailed governance structures have been prescribed, including Governing Councils, Academic Councils, and Finance Committees, ensuring institutional accountability and transparency.

Significantly, the law introduces mandatory provisions to protect student interests. These include:

Reservation of at least 25 percent seats for domiciles of Jammu and Kashmir

Provision of scholarships and freeships to a minimum of 10 percent of students

Transparent fee structures with a complete prohibition on capitation fees

Strict penalties, including imprisonment and fines, for violations such as sale of degrees or illegal fee collection

In addition, the Act includes detailed provisions to safeguard students in case of institutional failure, including transfer mechanisms and use of endowment funds to meet liabilities.

Private universities under the Act will operate as self-financing institutions, with no entitlement to government grants. Each institution must maintain an endowment fund and undergo annual audits, with financial disclosures made publicly available.

The legislation also allows foreign higher educational institutions to establish campuses in Jammu and Kashmir, subject to approval under existing national regulations. These institutions will have academic autonomy but remain subject to periodic quality audits and financial compliance requirements.

Civil society groups and education stakeholders have welcomed the passage of the Act, describing it as a long-awaited reform that balances expansion of educational opportunities with regulatory oversight. They noted that the legislation could help curb student outmigration and strengthen the region’s academic ecosystem.

The Statement of Objects and Reasons accompanying the Bill underscores the dual objective of expanding access while safeguarding quality. The government has emphasized that the law creates an enabling yet regulated environment for private investment in education, aligned with national standards.

With its passage, the Act marks a significant policy shift in Jammu and Kashmir’s higher education landscape, paving the way for new institutions while embedding mechanisms for accountability, equity, and academic excellence.
